There are multiple cases, where alleged safeguarding issues are exaggerated and unfortunately, it is families who are adversely affected.

No one is disputing that deaths are prevented by robust planning and intervention but not to acknowledge that risk averse practice can be potentially damaging is not to consider the broader perspective.

Believing that what one is doing is wonderful lulls the drive to improve.

In reply to Disillusioned. Not where I come from. Removal to prevent death or serious emotional sexual or physical injury maybe. Anything other than that does not meet threshold for even CP work. We obviously work in LAs where the approach is very very different. We are most certainly not risk adverse.

Laura, children are not removed due to cost of living or welfare reform. There is high burden of evidence required (rightly so) to remove children. Emotional abuse can be as impactful as physical abuse for example. You have to demonstrate impact on the child. No judge in the land would go on my view alone. It’s far more complicated than that. The CP team I work in is highly skilled, we work so hard to keep children with their parents, often covering evenings and weekends in our own time, why, because we came in the keep families together, we take risks everyday to do so. On the sad occasions we can’t support that, we go to court. ‘Good enough’ parenting required by the court is pretty low in my experience.

The child protection system is failing the children.

The concept of emotional abuse and significant risk of future harm is flagged about with such confidence with no evidential basis.

One worker may make a huge fuss about the state of the house even when there has been no accidental injuries. Very elaborately that state of the house will be mentioned in the care plan.

That is one of the reasons why social care has not reached the level of professionalism that teachers or physiotherapists reflect.

Actually having been a litigant in person, the family court is still very biased towards fathers and there needs to be huge changes to the matramonial clauses act and the child and families act,
My case could have had too many outcomes and I had to go back to the judge and the barrister because they both made mistakes that would have cost me thousands.
And the court or the police were not interested in the fact that my ex wife assaulted me in front of our son, and my only course of action was a financial dispute resolution.
There needs to clear guidance and information plus greater transparency.

This is very true, the single arguement that is being forced by women’s aid is every dangerous and candidate and has put children in a position of harm from domestic abusers that are in fact the mothers.

This review helps show how I believe the system and even the Cobb review was biased and has been detrimental to children. The gender discrimination shown to the father is also discrimination against the child due to human rights act article 14 and recent case law regards discrimination of a parent with PR.

My daughter and others (as well as myself) continue to suffer from the DA thanks to the discrimination of the courts and PD12J. I am also of the belief that the courts discrimination propagates parental alienation with these two separate issues often having a correlation.

I wholly agree with your analysis of the shortcomings of this hastily announced review. The entire Child Protection System is failing and it is the children and parents who are suffering.

Statistics show cases of child abuse have decreased over the last two years but the number of children removed from their families has increased.

The Family Court System is allowing the written evidence of a sole social worker, to be taken as the truth and not allowing the parents to defend the allegations made against them.

Furthermore the ambiguity of “emotional abuse” and the “significant risk of future harm”, two phrases extracted verbatim from The Children’s Act, are not sufficient evidence upon which children should be removed from loving families who are struggling with the current social issues such as welfare reform and the rising cost of living.

I agree wholeheartedly with this article. I believe it is, in the main , an issue around resources inside and outside the Family Court. It worked reasonably well until legal aid rules changed and this co incided with a move to under resourcing children and family support , moving them from a preemptive system to one of crisis management. The current state of affairs was entirely predictable ( if I could see it others better qualified than me will have seen it much quicker !) and is a perfect storm !
