Until AMHP training moves from a what I did on my holidays standard portfolio supplemented by a self defined reflection on “anti-oppressive practice”, the massive differences in how AMHPs interpret the MHA will continue to short change people in distress. Remember when ASWs had to sit an exam which was only abandoned because of the massive fail rate? I say its time to bring in rigour and objectivity. Set real measurable standards and get rid of all is valid subjective narratives that rely on individual qualities rather than proper knowledge. Better skills sets would stop the eternal injustice of decision making on the basis of someone having or lacking “insight”. AMHPs choose to disempower themselves by a fatalistic mindset that sees blame in “services” or lack of. There is a discomfort in acknowledging that far from being independent outsiders AMHPs are an integral part of a failed and abusive care ecology with its core being hospital admissions. I don’t blame AMHPs for seeking validation from doctors in the current set up. I just want them to own their part rather than look to blame everyone else. It’s the only way change will come. That said, they do provide quality biscuits when they visit our ward.

AMHP in our team says National AMHP Leads Network fed into the NHS Long Term Plan and an OBE was refused so clearly meaningful campaigning has been happening and career risks are being taken. MHA might not be racist as argued here but that still doesn’t absolve AMHPs from propping up a racist system. If AMHPs are incarcerating people in hospital because there are no alternative options, they need to have a concerted public campaign to agitate for those resources. “Not our doing” is not a get out clause. You either intervene with the most appropriate option or fight like professionals should and put the NHS and Local Authorities under the spotlight for failing people. If your are being forced to make decisions you don’t agree with take some career risks collectively. Walking away should never be an option for an AMHP.

I am a black woman, social worker and an AMHP, I would say that it is not the law (Mental Health Act ) that is racist, it is the lack of alternative to hospital admission for people from Black and Minority Ethnic people. Over the past 20 years there as been a reduction in least restrictive options. For example in one East London Borough one of the major resource used as an alternative to hospital admission for people of African and Caribbean origin was closed down. As an AMHP I always explore the least restrictive option. There was a time when mental health trust were committed to working along side community and religious groups, to help people develop an understanding of mental illness at the same time developing cultural perspective on mental health. The aim to reduce the number of people from being admitted to hospital under the Mental Health Act. Sadly all these good practice have disappeared. As an AMHP I am not racist in practice, I am conscious of the lack of resources available to support people experiencing mental distress from the BAME community. I wonder what consultation occurred to people from the BAME community who are still over-represented in mental health. Over ten years ago or more there was so many publications such as “Breaking the cycle of fear” which highlighted some of the issues raised from people of African and Caribbean community accessing mental health services, but still nothing as improved it as just got worse. In my opinion it is not necessarily the law that is racist, it is the systems around that have cut services that used to promote positive mental health for people from African and Caribbean community that have created problems which means more people are being detained in hospital, because there is no alternative for them.
