What about an autistic individuals who have capacity but are being misled by mate crime, or social or danger awareness are impaired enough that they do not realise they are getting into detrimental situations or making poor choices, not because making poor choices is their right but because they don’t understand consequences adequately. Even autistic adults with high IQ and able to logically explain a decision in a general sense can still not be applying it to themselves in real life. There can be a complete mismatch in logical understanding and relating that to self in real-time situations where they may have processing delays, impaired ability to understand body language or motivations of others. Parents may need to support that adult by parenting way past the age that a neurotypical adult child would need it and yet can be seen as a problem in that autistic adult child’s life and deemed controlling. Autistics are developmentally delayed even when that doesn’t apply to IQ and the rule book needs throwing out when it comes to understanding the family dynamics of these types of situation.

That’s not ‘safeguarding’ in a practical sense, that’s seeking a Court judgment, and it tells us little about where we get the authority from to take decisions under the safeguarding rubric for those who have capacity. The answer is simply ‘We can still go to Court’.

‘Do you know what the Inherent Jurisdiction is?’ would have made a better title.

Educate yourselves much better on how bad the alternatives are and spend many hours with the person you are trying to help before imposing yourself
